Phil Rath, spokesman for a coalition of dispensaries called the United Medical Marijuana Coalition, told the Planning Commission that streamlining and easing the approval process for legal marijuana businesses would help stamp out the local black market for the drug.
But opponents of legalized marijuana say the city has already bent over backwards for the industry. They also complained that the city has been slow to crack down on marijuana billboard ads, a move city officials say they plan to make later this year, after more than 20 months of delays. Some Planning Commission members say they are frustrated that the 24 approved dispensaries are not more equally dispersed across the city. Four City Council districts — 2, 6, 7 and 8 — have the maximum four approved dispensaries, while District 5 has none and Districts 4 and 9 have one each.
Commissioner James Whalen said he was frustrated that the city approval process required permits to be issued to any applicant who met all of the criteria, regardless of whether a superior proposal was vying for one of the scarce permits. The commission also questioned whether the cap of four dispensaries per council district makes sense, and whether a cap of 40 total marijuana production facilities citywide is a good idea. None of the 40 marijuana production facilities approved under a new city law have begun operations.
And the two dozen semi-legal marijuana production businesses that have been supplying local dispensaries as a stopgap must shut down by Thursday. The October legislation making marijuana cultivation fully legal in San Diego gave those semi-legal cultivators two years to continue operating until the 40 production facilities permits were approved.
